Former LaMarque employees file whistle-blower suit against city

GALVESTON - Two Galveston County women claim the city of La Marque fired them four months ago because they engaged in whistleblowing, recent court documents say.


In a lawsuit filed Sept. 13 against their former employer in Galveston County District Court, Lydia Alcala-Garcia and Janet Solis claim the city refused to address the reportedly illegal activities of City Manager Eric Gage and terminated them in June for filing a report with the Galveston County District Attorney's Office.

Alcala-Garcia was the city clerk while Solis worked as the director of human resources and court administrator. They held their positions until June 14, according to the suit.

Alcala-Garcia states she went to the La Marque City Council at the beginning of the year with allegations that Gage was deleting e-mails from an Open Records request to which she was responding. Among her job responsibilities is replying to such requests, she says.

The suit points out that Gage sat at Alcala-Garcia's desk and erased the e-mails, adding he ignored her pleas not to. The city council did not fully explore the issue, Alcala-Garcia claims.

A month after the city council meeting, the plaintiffs sought the assistance of the district attorney's office. They alleged Gage violated the state's Open Record and Open Meeting laws, committed payroll fraud, and used government property for personal gain.

According to the complaint, the accusations were also reported to La Marque Mayor Geraldine Sam, however, the defendant dismissed Alcala-Garcia and Solis shortly afterwards. The plaintiffs claim the only reason given for their termination was "using the city computer for political purposes," the original petition says.

Alcala-Garcia and Solis argue that the discussion and vote of their terminations was not fully disclosed to the public and the city acted out of retaliation to them reporting violations of the law.

Consequently, each complainant seeks at least $500,000 in damages as well as a jury trial.



Attorney Anthony P. Griffin of Galveston is representing Alcala-Garcia and Solis.

The case has been assigned to Galveston County 56th District Court Judge Lonnie Cox.

An appointment notice was made without answering the Fire Chiefs questions as to why he was removing his appointment as the Fire Marshal without Cause?


An email notice to the Mayor and Council of the new Fire Marshals Appointment that indicates the individual will now have two full time jobs. One as the Fire Marshal for the City of La Marque and One as the Assistant Fire Chief for the City of Stafford. That’s 80 hours a week.

But he just informed the Fire Chief that the individual would also be starting the Police Academy to obtain his TECLOSE certification.

How many hours are there in a work week???

Barrett: No-vote on fire contract was retaliation

LA MARQUE — City council members were trying to send a message to the firefighters union when they let a new collective bargaining agreement sit idle for six months, a veteran councilwoman and the lead member of the negotiating committee conceded.

Councilwoman Deanie Barrett also partially confirmed the fire chief’s claims city council members had suggested they would approve the contract if he could have the union president removed. For months, Barrett and the other council members denied their inaction on the contract in September resulted from collusion or from retribution for someone having reported an infraction by Mayor Pro Tem Keith Bell.

Bell, a Galveston firefighter, was suspended after he attended a council meeting wearing his uniform.

Barrett maintains council members did not meet in secret to discuss holding up the contract, but she said the inaction was “more of a stall to prove a point.”

The three-year collective bargaining agreement, which all sides had said was acceptable before it came up for council approval eight months ago, didn’t even receive a motion for approval.

Barrett said no one on council had coordinated the lack of action.

“It just sort of happened that night,” she said.

Lead Up To Battle

The council left the contract in limbo just a week after Bell assailed Fire Chief Todd Zacherl about a proposal to buy a new fire truck. Bell said he thought the proposal included too many unneeded items and was overpriced.

Bell was wearing his Galveston Fire Department uniform during that meeting and was supposed to be on duty on the island at the time. Bell admits he was still in uniform at the meeting but said he had arranged for someone to cover his shift while he was attending the council session.

He later was suspended for wearing the uniform and for leaving his post without permission after his infraction was reported to Galveston Fire Department administrators.

Galveston officials have refused to discuss Bell’s suspension.

Bell, however, blamed La Marque firefighters and union President John Brasher in particular for reporting the infractions.

The next week, the collective bargaining agreement was up for a vote, but it died for the lack of a motion.

Council members Larry Mann and Connie Trube said they were waiting for Barrett — who led the city’s negotiating team — to make a motion before offering a second. Bell said he did not think it was proper he make a motion for approval because he is also a firefighter and considered it a conflict of interest.

Show Of Support

Barrett said the inaction was a show of solidarity for Bell but was not a violation of open meetings laws.

Still, she said she now regrets the move and would not do it again since she and Bell now are on opposing sides of several issues, including a contract for City Manager Eric Gage and giving Police Chief Randall Aragon the added title of public safety director and the responsibility of supervising Zacherl, who has filed a grievance against the city manager.

“You back a person, and it bites you on the butt,” Barrett said.

The firefighters union sued the city and reached an accord on the contract in March.

Union President Stunned

Brasher said he was “floored” by Barrett’s statement.

“It just confirms what we had already figured out,” he said. “I don’t know what to say to that. All it did was cost taxpayers money and us money to hire an attorney.”

On that part, Barrett seemed to agree.

“This fire thing really got out of hand over nothing,” she said.

And it has divided the city, as well as council. Factions have formed in opposition to Gage, Barrett, Mann and Trube for other actions that firefighters said were retaliation against the union and members of the volunteer fire department who supported the paid firefighters.

That overflowed into vicious fights over Gage’s contract, the public safety director position, the hiring of a fire marshal and other personnel moves. There also is going to be a recall election in November after residents successfully petitioned for an effort to oust Barrett, Mann and Trube.

Push To Oust Union Boss

Barrett’s revelation about the contract dispute wasn’t the only disclosure. She also confirmed key parts of an allegation made by Zacherl in complaints he filed with the Equal Employment Opportunity Commission stating he had been instructed to find a way to have Brasher removed as union president in order to secure the firefighters’ contract.

Gage also acknowledged it was suggested in a meeting in Gage’s office with Zacherl, Barrett and Bell as they tried to find a way to resolve the stalemate.

Zacherl alleges Gage instructed him to find a way to get Brasher removed. Gage denied that but said during a closed-door meeting last year, “someone in the room did suggest that.”

Asked who made that suggestion, Gage said: “I don’t remember. I was sitting there going through other stuff, and I heard it.”

Asked what was said, Gage responded: “One of the council members, I don’t remember who, said that if (Brasher) was gone, they would get their contract.”

Conflicting Accounts

When asked whether a man or a woman had the comment, Gage said he couldn’t remember. He also said Bell had done most of the talking.

Bell denied he made the statement and said he recalls no such meeting.

“I don’t remember that statement being said,” Bell said. “I don’t remember a meeting of that nature or anything of that nature being said any time.”

Bell said that during a recent executive session, “it could be possible that somebody may have admitted something.”

He would not discuss the matter further, citing the confidentiality of the executive session that was followed by a reprimand of Gage for actions he took in creating the public safety director’s position.

Barrett, however, said she clearly remembers the meeting and that she and Bell made the statement together. She said it was an offhand comment, not a directive.

“The four of us were sitting there, it was just a statement when someone asked, ‘How can we resolve this,’” Barrett said. “I made (the statement) halfway. It was like one person started to say it and the other finished the sentence.”


She did not say who started the comment or who ended it but said it was neither Zacherl nor Gage.

“It was never intended as an order or a demand,” she said. “We can’t do that. It was just a statement, and everyone seemed to agree to it.”

Rumor: If the recall of all three (3) Councilmember’s is successful, the City of La Marque will cease and the state will come in and take over.

The City of La Marque is a Council-Manager Government. See City Charter: Section 1.02 Form of Government. The powers of Council are to enact legislation, adopt budgets, determine policies and appoint a city manager and other powers prescribed by this charter. The budget has been passed and there are no current policies or legislation that must be acted upon. The city manager runs the city; therefore it will be business as usual if all three councilmember’s are successfully recalled. If two of the three are recalled, there is still a quorum, there for the council can still function in full force. See below references from the City of La Marque Charter.

Section 1.02. Form of government.
The municipal government provided by this charter shall be known as the "council-manager government."
Pursuant to this charter and subject only to the limitations imposed by the state constitution, the statutes of this state and by this charter, all powers of the city shall be vested in an elective council, hereinafter referred to as the "council" which shall enact local legislation, adopt budgets, determine policies and appoint the city manager, who in turn shall execute the laws and administer the government of the city. All powers of the city shall be exercised in the manner prescribed by this charter, or if the manner be not prescribed, then in such manner as may be prescribed by ordinance, the state constitution or the statutes of the state.
State law references: Form of government in home rule municipality, V.T.C.A., Local Government Code § 26.001.

Section 5.17. Results of recall election.
If a majority of the votes cast at a recall election shall be against the recall of any officer named on the ballot, he shall continue in office for the remainder of his unexpired term, subject to recall as before.
If a majority of the votes cast at such an election be for the recall of any officer named on the ballot, he shall, regardless of any technical defects in the recall petition, be deemed removed from office and the vacancy shall be filled as provided by Section 2.03 of this charter.

Section 2.03. Vacancies in council.
A vacancy in the city council shall be filled by a person of the city, having the qualifications of a councilman, by a majority vote of the remaining members of the city council. Where more than one vacancy shall exist at any one time, than [then] a special election shall be called in the next date authorized by state law and vacancies filled in the same manner as herein provided for general elections; provided however, if such vacancies occur within ninety days of the next general election, then no special election shall be called and the vacancies shall not be filled.

Hey 7. Yep, he is on meds for it...and I think it's Lyrica? I could be wrong....but I think that's what it is. The job fairs he went to were not so great. But he has put in many hours sending out resumes. This is so hard for him because he is a trpe A personalitiy. A friend of mine just brought me a copy of a letter addressed to council. Whoever wrote it didn't even sign it but made slanderous accusations towards our City Manager...and told how they were dissappointed in council, due to the number of employees either fired, or who resigned. Well dear citizens, it's called cleaning house......and making the employees realize, they are not the ones that make decisions, and run city hall. I stand behind our manager 100%. Because he is doing things that should have been done years ago! Just recently, someone from the water dept. decided to remove the $ donations to the park's board and VFD. She said she got phone calls from people complaining about that. She should have notified the city manager....who could have told city council. So, this is just another thing the city manager had to correct. Early last summer, he closed the kitchen for a couple of days, because those who used it, let it get filthy. He told them either clean it up...or he would close it. They chose to let it stay dirty...so he closed it. Everyone was in an uproar. They were so stupid, they don't even take into consideration, that a lunch room is not mandatory for employees. And that lunch room is VERY nice! Full size fridge, microwave, complete sink and lots of cabinets...nice coffee maker, vending machine for soft drinks...and even a large size TV! Is it too much to ask, that they clean up after themselves? I don't think so. That kitchen is large enough, it could easily be turned into an office space which we are running short on! We had an employee who was letting the other employees have one of the parks for free to have parties and such. These employees would do it so a friend could use it at no charge. These employees don't even live here. This same person was signing checks she was not authorized to sign. Basically, the employees were doing as they wanted. What a great day! I feel SO good(even though I am still tired from last night).

7, the kitchen now stays clean now. Guess they learned their lesson. And yes, this person was signing checks for purchases etc. She left because she got caught. And yes...one of our parks has a pavillion. It's an awesome park, and gets better all the time due to the Parks board..which I use to be a member of. The charge is for the use of the pavillion.....not the whole park.
At last night's meeting......we were to discuss and approve the city manager's contract. 3 of us voted yes, with the mayor and mayor pro-tem voting against it. In the open meeting, and executive session...it was a battle between the races. It shouldn't have been that way. But the above mentioned are trying to control by intimidation. That is NOT the way to conduct business. The mayor pro-tem was making things seem different from the truth. He was trying to belittle certain people.....that is not right, and I made it a point to correct what he said. I had to do that twice. For instance, with a subject regarding the city attorney...he made it sound like it was 'mandatory'....rather than what the attorney actually said which was 'a courtesy.' Totally different animal. The mayor went against proper protacol, and I called her on it...and she slammed the gavel down on me...and another council member. That was so disrespectful! I will correct this at the next meeting. I will read to her....with the public listening.....the proper way to conduct a council meeting. I have given everyone the written version.....and have talked with the mayor directly. But apprently, she still doesn't 'get it.' Next time I will make sure everyone is aware of what she is doing. She has the grand idea that since she is mayor.....no one has control over her...and that she can do as she pleases. Well, I got news for her.....she is dead wrong!! She makes it so difficult to be part of any meeting. She starts to babble on and on..and I am talking for HOURS!
The council chambers was filled with fire fighters last night. It was said that if we gave the city manager a contract, that the VFD would disban. Well...I hope they do. That would be the end of that issue. But if they don't...then I am ready to tell them as far as I am concerned, they are on their own. No more help from the city and the citizens($ donation from the water bill).
Yesterday, from the time I got up.....till late...I had either someone on the phone or someone was here talking to me about the meeting. And it has already started this morning! And of course it made the front page of the newspaper this morning. Anyway.......the 3 of us have made a pact, to continue to do what we think is best for the citizens of our little town. We don't have any personal agendas.....just trying to do the best job we know how...for ALL the people...not just a chosen few.
Ok, now that I have bored eveyone to tears....I feel better! I hope everyone has a great day!

Good morning all!
It's Robert's Rules of Order. And I have said before(in council meeting) that we need to have a copy and have some knowlwdgable in it...and have them there so we can refer to it. I also have the Texas Home Rules Charter book, that covers items that is not in our local charter. In it...I found a legal way to force our Mayor Pro-Tem to step down. And in it...it quotes the Texas Constitution. I also called the Secretary of State...and they agreed...he has to step down. But we have to have a 'special election' to replace his position(councilmember). Today I intend on researching the TML site for more info. on the proper procedures for running a council meeting. Our mayor has the grand idea that it's HER meeting and she can do as she pleases......I will prove her wrong on this as well. And my head has been spinning since Monday night.The building was built and belongs to the VFD. But....the papers state, that if the building is no longer used for what it was built for...or the VFD disbans.....the building goes to the city. And yes...we can make good use of it. Oh, and yesterday, I got the final papers for the lawsuit that the paid FD had filed against us. We forced them to remove the false allegations they had made against members of council. If they had not removed it...we were going to press on, and make them prove what they alleged. And we knew they couldn't prove it. So, they removed it...and now we move on. Thank goodness!I have much more reading and searching to do. After I jump in the tub. I hope everyone has a super duper day!!!! :)

Hey 7. Well, my research didn't get me what I really wanted. I think we may need to write a resolution or something to do it. Even Robert's Rules didn't cover what we need. I still have to look into TML's site(Texas Muncipal League)...they may have what we need. My gosh.....somewhere there HAS to be something saying that the mayor can't ramble on and on for hours without interruption. It's not that she shouldn't have her say. But she hollers and carries on like a 'babbling idiot.' Sorry....but that is what the citizens in the audience say. A meeting that should last no longer than an hour, shouldn't go on for 3 or 4...just because the mayor thinks what she has to say is THAT important. She does not have respect for the rest of council. But yet, we are suppose to respect her. She has allowed the title of 'mayor' go to her head. And here I still can't get use to being called a council member. Anyway, hate to bore you...but it feels good to get this stuff off my chest. Thanks for listening!! Oh you poor people and your snow! You have got to be so tired of it....aren't you? I know it's still winter, but it seems like you guys hardly get a break from one snow storm to another.7, how are you liking the Olympics? I am so unset at the coverage that NBC is giving it. After watching ABC do it for so many years......I got spoiled. NBC does not come near doing the games justice...nor their viewing audience. But I have muddled through it.Ok, guess I will check out a few more threads and then start researching again. Hope everyone has a great day! :)

Hey 7......we have put on ther agenda for the special meeting that the three of us who approved and passed the contract are going to sign it. I have gotten word, she is going to try to tell us that we are going against the city charter. Well duh...I have the Texas Home Rule Charter book...and it says we can give the city manager a contract without it being stated in our charter. Man...talk about dumb. She does not have the ability to do her own research to back up what she says. The city attorney just says that SOMEONE has to sign it...it doesn't have to be the mayor. So, we are. We have 3 special meetings next week and we have to listen to her babble more. But we have already made plans to let her show how ignorant she is. I'll let you know how it goes. We have to hire an alternate city judge, and a city prosecuter. She says she needs to 'see them' before she can make up her mind. If she wants to 'see' who is a different color than the 3 of us...doesn't that have racial overtones??? We already know for a fact that one is of 'another' color...but he is not quailfied for the job. Hate to tell her...but that ain't gonna fly!!Ok...gotta scoot for now. Ya'll have a great day! :)

Good morning all!
I wasn't on much last night due to yesterday being the day from hell. Since our mayor didn't get things to go 'her way'.......she has asked the District Attorney to look into the 3 of us going against the Texas Opening Meetings Act. Soley on the fact we voted opposite of what she did. We could, by her not signing the city manager's contract, bring the the forefront, that she went against the city charter by trying to envoke the 'veto' power that she does NOT have. Besides talking with the DA...she has also called CNN news...and has apparently talked with Jesse Jackson to come down. So, heads up guys! You might see me on the news! I certainly hope that is NOT the case though! That only sheds negative light on our little city...which long ago she herself stated, she does not like. Hello???We could easily appoint the alternate judge and prosecuter by just reading their applications. Many live way too far away from our city, some are not qualified at all. It really isn't going to be that difficult. But again....the mayor and the mayor pro-tem are going to use the race card. The rest of us do not allow that to play in.....we go by who has the qualifications.....that's it. I'm sorry if the ones they want fall into that category. Since there are so many applying for these positions, we have to take 3 days to do the interviews. I will certainly let you know how it turns out.Wow, this year will certainly be the year for remembering the snow, huh? I've been trying to keep up with it on the news. I heard where...somewhere...a million people were/are without power? Mercy! Do ya'll have generators?? Or i hope you have gas or...

Hey Branson. I don't know happened....but nobody showed up! No media...not Quanell X......no supporters. I was so shocked.
Oh Branson....I agree. Especially when you are a council person...you are one 24/7. AND...of all people that should obey the laws...and be above any wrong doing, it's council members. We had a similair thing happned here years ago. But it was our mayor...and he was a good one. But his term was very close to be over anyway..so we let him continue on. Just because he was a good mayor, who made a huge mistake!! Most of the peopke did not know what even happened. Now if he would have had more time to serve on being mayor, I'm sure he would have steppped down. But he knew he blew his political career...and that did not bode well with the company he was working for either.I have found a legal way to get rid of our mayor pro-tem who has been making threatening remarks to our city manager and his secretary. He was running for another elective office(Justice of the Peace), while still sitting on council. No one let us know that was against the rules of the state. So.......we will be holding a special election to find someone to replace him.nAnd that should be soon too. And i have problems with the City Secretary for not telling us about this law. Talk about doing research! My head is spinning. We have been interviewing people for the Alternate Judge and Prosecuter positions. So much to do!Anyway.....are you going to do a 'recall' on him? I was the only one who did a successful one in this county. Others have tried but failed. The one I got rid of was also arrogant and power hungry.I have been working on some more legal stuff concerning the city.....and i am so tired. Think I am going to call it a night. Thnks, my gums back there are much better. But I burned the roof of my mouth right behind my front upper teeth...now that hurts worse. :( Oh well.Some people have started(sorta) a recall on the 3 councilmembers that voted differently than the mayor and mayor pro-tem. Stupid cirtizens!! WE are the ones watching out for them...NOT the other two! These people have got to be out of their minds! But...a lot has to happen before the election.

I think these people jumped the gun on a recall. They did it before thinking it out. I think in the end, they are going to look so foolish. I was on the phone till 12:30 this morning, and the calls started up at 9 this morning. Had a long talk with the reporter from the newspaper, what a jerk. He never prints what was actually said...or leaves out important points and makes us look stupid. But, the truth will prevail I think!!I bit down on a hot hamburger..and the cheese stuck to the roof of my mouth.Sweetie, your link isn't clickable. I can't copy an paste it either. Wish I could hear the song.Ok...back to cleaning house before anymore phone calls!!! Take care ya'll!!! :)

Morning all.
Another late night last night doing research into the recall election(no date set yet). IF all 3 of us should get recalled, then that puts a total stop to council meetings till another election is called for to replace us. Did these people think out what a recall(if successful) would do to our city??? This is scarey.Ok, sun is shining for now. Have some laundry to get done, and must go tot he store before it rains(suppose to) later on today. Hope everyone has a wonderful weekend!!! :)

Thanks 7. Mouth is much better. Meeting was very interesting. Yesterday, a citizen filed a petition to recall the mayor. So now.....all 5 will be on the ballot. This is so stupid. Excpet for the mayor. I'm telling ya.....it's so hard to conduct a meeting with her in charge. Anyway.....we shall see how it goes.My weekend was fine. Still need to go grocery shopping....and do some laundry. Ugh!It is so good to see this board starting to pick up some action. Can't wait till Wednesday and after that. There should be much to discuss! Nice to see new posters here too.Ok.....have to check out some other threads. Ya'll have a great day! :)

Hey guys! Just got off the phone. Someone is going to TRY to get all the recalls pulled back. That would be so good...not just for council, but the whole city. Yes 7, that means basically, the city almost comes to a halt. That is what I told everyone in the room last night. This is a no win situation. Every citizen will pay the price of the actions by a few. And the 3 of us MAY have legal recourse...not sure about that yet. Have to look into it. But that's not what I really want either.
Today, hubby and I went grocery shopping. Does anyone really want to know that it made it up to 75 today???!!!!! It was so nice for a change. But we are suppose to have another cool front come through. That will be our Easter spell as my folks always called it.Yes, thanks 7, mouth is all better, but still have a little allergy hanging on. Bought some more meds for that. Tomorrow I need to run to my favorite little kitchen gadget place and buy a new 4 cup coffee pot. Mine all went ka-put!Anyway, that's about it from here. Yes...so good to see all the new 'faces'(names) here! Tomorrow night should be fun. Hope everyone can make it on so we can talk about it!!!! I hope everyone has a great night. Going to check out some more threads.......I should be here for awhile longer.

Hey. Yes..it's better to be not have to runt he a/c due to the light bill! I sure am not complaining about that. The eather this morning is beautiful. Perfect weather for being outside...but the wind is blowing and I still have allergies. Ugh! Guess the garden, and painting the house will have to wait a lillte while longer.
No 7....I should get my packet some time today. I think they were hoping I woulkd 'pull' an item off the agenda at the last moment...but I am standing my ground!! NO ONE is going to intimidate me......or try to pull the wool over MY eyes!! They need to learn.....if 3 of us are being recalled because we violated the city charter(unknowingly), then people need to know that the other(mayor and mayor pro-tem) two broke STATE laws...but that seems to be ok? Hello??? But in Monday's night's Executive Sesson...I think the mayor is going to hang herself. I can't wait to see that! She has a bad bad of opening her mouth..and inserting her foot. As they say....what goes around, comes around!!! I'll keep you posted.
